Short answer Where a person goes, who they meet, how long they stay and how often — recorded with dates, times and locations by an operative who is not noticed. What happens in public space can lawfully be documented. What happens in private communications cannot, by anyone.
What no lawful investigation includes: reading messages, email or call records; placing tracking or listening devices; recording inside private premises; accessing accounts. These are criminal offences in Spain, they apply within a marriage, and material obtained that way shifts the case from what your partner did to what you did.

Short answer Not directly. Spain has no-fault divorce, so infidelity in itself does not determine the outcome. Where evidence does matter is indirectly — in questions of assets spent on a third party, and above all in cohabitation, which can affect an existing maintenance obligation.
That distinction is worth understanding before you spend anything. If your objective is a better divorce outcome, evidence of an affair alone may not deliver it, and a Spanish family lawyer will tell you the same. If your objective is to establish cohabitation in an existing maintenance dispute, that is a different case with a different evidential target — and one where a documented pattern is often decisive.
And if your objective is simply to know, that is a legitimate reason on its own. Most of our clients in these cases never use the report for anything.
Before you instruct
Can you investigate a partner in Spain while I'm abroad?
Yes, and it is a common instruction. You deal with us in English from wherever you are; the fieldwork and the signed report are Spanish and licensed, so the evidence holds here.
What should I do before I call?
Nothing, and that is deliberate. Do not confront them, do not follow them yourself, do not involve friends or family, and do not look through their phone. Each of those either ends your ability to find out or creates a legal problem of your own. Signs, and what they don't prove
Will I get photographs?
Where they can be obtained lawfully and are relevant, yes, as part of the report. What we will not do is obtain images in circumstances where doing so would be unlawful, however much they might seem to help.
Do you take cases where there's a protection order?
No. Where a court has ordered that a person be left alone, there is no legitimate interest in investigating them and we decline, including when the client is willing to pay.
Can I stop the investigation partway?
Yes. You are billed for work carried out and authorised, and people do sometimes decide midway that they no longer want the answer. That is a legitimate outcome.
